Fees to handle a tax matter (both collection and guidance cases) with the Internal Revenue Service (“IRS”) are determined upon a due diligence review of all of the facts and circumstances (e.g., simplicity, complexity, documentation, & status of tax law/policy). Additionally, the final fee will be greatly influenced by how the IRS will respond to or defend a particular tax issue/policy or proposed collection remedy.
Collection tax matters require the attorney to initially obtain and review the documentation being relied upon by the IRS to support its collection case. Obtaining that documentation is both time and paper intensive, considering the fact that a great deal of the collection process is handled through telephone discussions with IRS personnel and computer systems that are not timely in their responses.
My fee schedule is competitive with the average hourly rate and retainer deposit for collection tax matters and is available upon request by e-mail. The fee schedule to handle an IRS guidance request (corporate or other) is determined on a case-by-case basis and is also available upon e-mail request.
We will not generally quote either a flat fee or the number of hours guesstimate for IRS representation because of the many uncertainties and unforeseen difficulties in dealing with the IRS. Accordingly, we will quote a flat fee or maximum fee for our Collection Checklist Service.
